“IPiù” PRIZE PROMOTION REGULATIONS

Following the extension, the IPiù prize contest will be marketed as “DRIV&”.

The Promoter hereby announces the extension of the Regulations and proceeds to supplement certain parts thereof in the manner indicated below. It should be noted that the recipients have been duly notified through the channels available for participation in the operation.

The additions are understood to be effective from 01/02/2026 and it is specified that nothing else has been changed other than what is stated in this document.

The additions/changes to the Regulations have been highlighted in yellow, while the deleted parts have been crossed out.

RECITALS

The Promoter Italiana Petroli S.p.A. (for the sake of brevity, also “IP“) has created a loyalty program for its customers called “IPiù” effective from 06/11/2023. The program will be extended and implemented in the following ways:

  • the IPiù program will be extended until 15/03/2027;
  • ESE S.r.l., a group company and subsidiary of IP, is interested in participating as a co-promoter in the IPiù program to extend it, in synergy with IP, to all Esso-branded service stations. The IPiù program will therefore be developed so that customers of Esso-branded service stations, and others, can also enjoy the benefits related to this initiative; the program thus developed will be marketed as DRIV& (for brevity also “Program”);
  • the Program will be aimed at customers of IP-branded, Esso-branded and/or one of the other group companies, whether parent or subsidiary, including those owned respectively by IP or ESE, supplied by the latter, in order to incentivise customers through the award of points and the possibility of obtaining prizes or discounts;
  • IP and ESE may decide by mutual agreement to extend the program to other owners of service stations under their own brand or third-party brands that will be supplied by IP or ESE;
  • customers already enrolled in the IPiù program will retain the points already accumulated, if not used, which will remain valid with the extension and can be used to redeem the rewards available;
  • new logic has been introduced for obtaining points useful for redeeming prizes in the ways specified below;

GLOSSARY

DRIV& – corresponds to the name under which the IPiù program will be marketed following its implementation. This nomenclature will also be applied to the reference App and to the points acquired during participation in the Program

PROMOTER – corresponds to the entity (Italiana Petroli S.p.A.) that has promoted the IPiù prize operation and that organises, develops and manages the Program in all its phases.

CO-PROMOTER – corresponds to the entity (ESE S.r.l.) that will promote the Program at Esso-branded service stations. ESE S.r.l. and the Promoter will ensure coordinated and coherent management, including through the involvement of their respective business partners, as well as coordinating the related processes and defining the marketing initiatives.

DELEGATE – corresponds to the entity (Advice Group S.p.A.) engaged by the Promoter and the Co-Promoter to fulfil the management of the ministerial practices of this prize promotion. It is authorised to carry out the following activities: drafting of the regulations, communication (filing) to the competent ministry, closing of the promotion, maintenance of relations with the bodies in charge and any other activity necessary for the proper conduct of the event.

DRIV&R CODE – corresponds to the Customer’s identifier within the Program. Before the extension, the same code was identified with the name of the Card.

This document (hereinafter the “Regulations“) governs, pursuant to the provisions of Articles 10 and 11 of Presidential Decree 430/2001 (hereinafter the “Presidential Decree“), the operation of the IPiù prize promotion that will be marketed as DRIV& after its implementation (hereinafter the “Program“) and the relative conditions of participation in the manner indicated below.

The promoter of the Program is Italiana Petroli SpA, in the person of its pro-tempore legal representative, with registered office in Via Salaria no. 1322, 00138 Rome, tax code and VAT number 00051570893 (hereinafter “Italiana Petroli” or “Promoter“).

The Co-Promoter is ESE S.r.l., in the person of its legal representative, with registered office in Via Salaria no. 1322, 00138 Rome, tax code and VAT number 17112421007.

All the subjects operating in the distribution networks with the brands available to IP or ESE or one of the other companies of the group (parent companies and subsidiaries) or companies owned respectively by IP or ESE, including retailers and managers participating in the Program (hereinafter the “Points of Sale“) will be called “Partners“. During the course of the Program, IP and ESE may decide by mutual agreement to extend the Program to other owners of service stations under their own brand or third parties who may join, even for limited periods of time. In such cases, as well as in all cases where this is necessary due to changes in the mechanics and/or in the prizes, the Regulations will be amended/updated in compliance with the provisions of the Presidential Decree. An updated version of the Regulations will always be available in the DRIV& APP (hereinafter the “APP“) and on the DRIV& website (hereinafter the “Website“) – with domain Driveloyalty.it, as well as at the headquarters of the Promoter and the company Advice Group S.p.A. as a delegated party pursuant to Article 5 paragraph 3 of the Presidential Decree.

Appropriate communication of the initiative will be provided to the recipients through the use of all the information channels provided.

1. RECIPIENTS

The Program is aimed at all natural persons of legal age, qualifying as “consumers”, resident/domiciled in the Program’s coverage area as specified below, holders of the relevant DRIV&R Code (hereinafter the “Customers”).

The managers of the Points of Sale as owners or legal representatives of the management, any of their partners, employees, collaborators and their close relatives are excluded from participating in the Program. Refuelling of heavy vehicles (over 3.5 tonnes) is also excluded.

Anyone who joins the Program expressly accepts all the provisions of these Regulations and any updates thereto.

2. PROMOTIONAL PRODUCTS/SERVICES

The following are relevant for the purposes of customer participation in the Program and for the acquisition of points:

  • fuels (petrol, diesel, LPG and methane) for motor vehicles, motorcycles and light commercial vehicles (weighing less than 3.5 tonnes) for refuelling at the Points of Sale participating in the Program, as explained above, both in Full-service and Self-service. Refuelling carried out using petrol cards as indicated in paragraph 5.2.1 of the Regulations is excluded from participation.

NB: the Promoter and the Co-Promoter reserve the right to integrate/modify at any time, and even for limited periods, the type of products/services in promotion as well as the “virtuous actions” provided for in paragraph 5.2.1 below that allow the accumulation of PASS DRIV& and DRIV& POINTS by providing Customers with extensive communication through the channels used for this initiative.

 

3. DURATION OF THE PROGRAM

The Program will be valid

from 06/11/2023 to 15/03/2027

(including the deadline for requesting Rewards).

Points can be accumulated

from 06/11/2023 until 15/02/2027.

The Rewards provided for in the most up-to-date version of the Regulations may be requested by 15/03/2027 and in any case within the limit of the request period specified in the Regulations for each type/individual Reward.

Customers already enrolled in the IPiù program will continue to accrue as provided for in the Regulations, and no points reset or change in the level reached until 01/02/2026 will be applied following the extension

 

4. COVERAGE AREA

The Program is active in the Points of Sale located in the territory of the Italian Republic and the Republic of San Marino.

 

5. HOW TO PARTICIPATE

Customers who purchase the products/services on promotion referred to in paragraph 2 of the Regulations (hereinafter the “Products” or, individually, the “Product”), in compliance with the following provisions, will accrue PASS DRIV& and DRIV& POINTS, to a variable extent in relation to the type of product/service purchased, the method of delivery used and/or in consideration of specific temporary promotions of products that will represent more favourable conditions for participation in the Program.

Participation in the Program, both with regard to the accumulation of PASS DRIV& and DRIV& POINTS points and for any other related activity (request for Prizes, etc.), will be managed in three ways:

  • DRIV& APP: the user can download the DRIV& APP free of charge through the app stores on iOS and Android systems, register through the appropriate form or, if already registered, access the application, in which, through the dedicated area, they can use the services related to the Program (by way of example and not limited to: the points balance, the transaction history, etc.) and display their identification code (hereinafter the “DRIV&R Code”), which uniquely identifies them within the Program;
  • POS equipment present at the Points of Sale (hereinafter the “POS”) that allow you to credit the DRIV& PASSES and DRIV& POINTS by showing the manager the code “TO OBTAIN POINTS and DRIV& PASSES” (different from the DRIV&R Code) available on the APP and/or by reading, via magnetic strip, the Italian Health Insurance Card upon presentation of the same;
  • OPT equipment present at the enabled Points of Sale (hereinafter “OPT”) that allow the Customer to be recognised and to credit DRIV& PASSES and DRIV& POINTS by entering the code “TO OBTAIN DRIV& POINTS and DRIV& PASSES” available on the APP and/or by reading, via magnetic strip, the Italian Health Insurance Card, upon insertion of the same.

Participation in the Program excludes the possibility of accessing, for the same purchase, other promotional initiatives that may be active at the Points of Sale, unless otherwise indicated at the Point of Sale itself and/or in the regulations of such initiatives. The Customer always has the right to choose which initiative to participate in.

The Promoter and the Co-Promoter reserve the right to carry out checks on participations at any time. Any irregularities, the absence of the participation requirements or the identification of conduct deemed fraudulent or illegitimate, will cause the suspension of the participation account concerned, pending the necessary checks; any prizes requested by Customers for whom non-compliant behaviour is suspected will be blocked until the completion of any investigations.

Any fraudulent, irregular or illegitimate behaviour will be reported to the competent authorities.

 

5.1 REGISTRATION FOR THE PROGRAM

To register for the Program, the user can choose one of the following methods:

  1. registration on the DRIV& APP: at the end of the registration, the Customer will be able to view their DRIV&R Code in the area dedicated to their profile;
  2. registration at the Point of Sale: registration can be done by handing over your Italian Health Insurance Card with magnetic stripe to the Point of Sale manager, who reads it through the POS acquiring only the name, surname, date of birth and tax code. Once the aforementioned data has been entered, the POS will request the Customer’s mobile phone number (mandatory data) and to express the choice of whether or not to consent to the processing of personal data for any further purposes that will always be updated within the privacy policy of the Program. At the end of the aforementioned reading, data entry and expression of consent operations, the POS will print a summary validation pre-receipt with all the information indicated and will await final validation by the Customer. The receipt issued to the Customer shows the DRIV&R Code created and the DRIV& POINTS.

The tax code read from the Italian Health Insurance Card must not be present in the personal data of another already active DRIV&R Code.

 

Notes:

Each natural person identified by the tax code, name, surname and date of birth, can request only one DRIV&R Code in the entire promotion period; all the aforementioned data are mandatory. If the Promoter and the Co-Promoter find that the same natural person has activated several DRIV&R Codes, only the last DRIV&R Code requested in chronological order will be recognised as valid for the purposes of participation in the Program and all will be cancelled, with consequent loss of the accumulated DRIV& POINTS and DRIV& PASSES, subject to the exceptions provided for in the Regulations.

The mobile number issued during registration can also be associated with a single DRIV&R Code; the Promoter and the Co-Promoter reserve the right to cancel the DRIV&R Code that presents the same associated mobile number with consequent loss of the accumulated DRIV& PASSES and DRIV& POINTS.

The Promoter and the Co-Promoter will not be liable in any way for any failure to use or for improper, irregular and/or illegal use, even if by persons other than the Customers.

5.2 ACCRUAL OF DRIV& PASSES and DRIV& POINTS

The performance of the provisions of the Regulations allows each holder of a DRIV&R Code to accumulate DRIV& PASSES and DRIV& POINTS in equal measure in the ways indicated below.

The following may be subject to modification/integration in relation to new methods of accrual of DRIV& PASSES and DRIV& POINTS that may be established by the Promoter and the Co-Promoter. Any changes will be announced in the most up-to-date version of the Regulations, which is always available in the APP and on the Website.

The balance of the DRIV& PASSES and DRIV& POINTS is visible in the appropriate section of the DRIV& APP , while only the balance of the DRIV& POINTS will be visible on the receipt that will be issued at each refuelling carried out in compliance with the Regulations by POS or OPT.

The collection of DRIV& PASSES and DRIV& POINTS allows you to obtain advantages and/or prizes as specified below.

The DRIV& PASSES allow you to reach the different levels provided by the Program and called DRIV&, DRIV & GOLD, DRIV & PLATINUM which are accessed according to the points accumulated as per the table below:

Each level is associated with a points multiplier as specified below, referable to fuel purchases.

The DRIV& PASS balance will always be updated incrementally following the completion of the actions required for the accumulation of points as per the Regulations. No reductions will be applied except in cases of fraudulent and/or irregular behaviour attributable to the Customer.

 

DRIV& PASSES allow access to the different levels as specified above. DRIV& POINTS allow you to obtain the rewards available and listed in the relevant Catalogue. Depending on the DRIV& POINTS accumulated, the

Customer can choose different types of rewards. Following the completion of each action as indicated in the following paragraph 5.2.1. of the Regulations or a reward request, the available DRIV& POINTS balance and possibly the relative DRIV& PASS will be updated. Once a reward request has been made, it will no longer be possible to cancel it and it is specified that the balance may be updated even after an action has been carried out, especially if this requires verification by the Promoter and the Co-Promoter. No responsibility can be attributed to the latter for non-credits due to the irregular, negligent or unlawful conduct of the Customers.

5.2.1 METHOD OF ACCUMULATING DRIV& PASSES and DRIV& POINTS

Customers who are recipients of the Program can accumulate DRIV& PASSES and DRIV& POINTS through the following different actions:

  • THROUGH REFUELLING as specified in the Regulations and in particular in paragraph 5.2.1 letter A;
  • THROUGH the performance of VIRTUOUS ACTIONS: these are activities that are made available to Customers in the appropriate sections of the DRIV& APP. For each action available, precise instructions will be given to complete what is required: if carried out correctly, they allow the obtaining of DRIV& PASSES and DRIV& POINTS as indicated in the individual action and better specified in paragraph 5.2.1 letter B;
  • THROUGH the WELCOME PACK, which will bring the credit of 70 DRIV& POINTS and 70 DRIV& PASSES directly to all Customers who register for the first time in the APP from 01/02/2026. The Welcome Pack aims to reward users who register for the Program for the first time;
  • THROUGH the SHARING of the “friend code” as specified in paragraph 5.2.1 letter C;
  • THROUGH BONUS POINTS, only if made available by the Promoter and the Co-Promoter as per paragraph 5.2.1 letter D.

DRIV& PASSES and DRIV& POINTS will be credited in such a way as to always allow their possible use for redeeming a Reward, without prejudice to the right of the Promoter and Co-Promoter to carry out checks and/or cancel DRIV& POINTS and DRIV& PASSES in the event of any irregularities being found.

The Promoter and the Co-Promoter reserve the right to supplement and/or modify at any time, and also for limited periods, the type of products/services and the “virtuous actions” referred to in the Regulations that allow the accumulation of DRIV& PASSES and DRIV& POINTS, providing participants with extensive communication through the channels used for the Program.

 

A. METHOD OF ACCUMULATING DRIV& PASSES and DRIV& POINTS

THROUGH REFUELLING

Customers who, during the promotional period referred to in the Regulations, purchase the Products at the participating Points of Sale and

  • present their DRIV&R Code “TO OBTAIN DRIV& POINTS AND PASSES” to the Point of Sale manager at the time of payment, for the Full-service mode
  • or enter their DRIV&R Code “TO OBTAIN POINTS AND DRIV& PASSES”, for refuelling in Self-service, accrue DRIV& PASSES and DRIV& POINTS as indicated below:

FULL SERVICE

DRIV& PASSES and DRIV& POINTS are awarded for each whole litre. Dispensing fractions of a litre does not entitle you to points (e.g. 15.7 litres of diesel with Self refuelling will award 15 points). The number of litres calculated in this way is the basis for any subsequent multiplication.

The maximum amount of product for each transaction that will be considered for the purposes mentioned above (accumulation of DRIV& PASS and DRIV& POINTS) and applicable to all participating Points of Sale will be equal to:

  • 100 L for petrol and diesel;
  • 60 LT/KG for LPG and Methane.

In any case, monthly quantities (calendar month) exceeding 300 LT for all categories of Products purchased will not be considered for the above purposes.

Any purchases made beyond the thresholds indicated above will therefore not give the right to accumulate PASS DRIV& and DRIV& POINTS for the amount exceeding the limit.

It should be noted that the DRIV& PASS and DRIV& POINTS are recognised for only one refuelling per day regardless of the amount spent, subject to the above limits, and the first refuelling carried out on the day from 00:00:00 to 23:59:59 of the same day will be taken into account.

The Promoter and the Co-Promoter reserve the right to modify the methods of accumulation of DRIV& PASSES and DRIV& POINTS, giving adequate notice to Customers and to carry out all the checks deemed necessary before confirming and/or crediting the amount due.

DRIV& PASSES and DRIV& POINTS will be credited electronically at the time of payment for the Products; the credit may also be applied at a later time than the refuelling or purchase.

In the event that the Customer is unable to present to the manager or enter through OPT them DRIV&R Code “TO OBTAIN POINTS AND DRIV& PASSES”, they can request, before refuelling, directly through OPT or to the manager in case of refuelling in Full-service mode, to obtain the appropriate receipt showing the barcode that will allow them to recover the DRIV& POINTS relating to the transaction in the “recover transaction” section within the APP.

If the POS/OPT is temporarily out of service, it will not be possible to proceed with the accumulation of DRIV& PASSES and DRIV& POINTS, and the manager, if present, must inform the Customer of this before refuelling.

Refuelling made through the use of oil payment cards ARE EXCLUDED from participation and therefore will not allow the accumulation of DRIV& PASSES and DRIV& POINTS.

 

A1. DRIV& PASS and DRIV& POINTS MULTIPLIERS

Upon first access to the Program following registration, the Customer is automatically associated with the “DRIV&” level , and may, according to methods broadly defined by the Regulations and also reported within the DRIV& APP, access the subsequent “DRIV& GOLD” and “DRIV& PLATINUM” levels.

Reaching a level allows you to obtain a specific multiplier that is applied to the calculation of the DRIV& PASS and DRIV & POINTS associated with each purchase of Products.

The multipliers applied are as follows:

DRIV& GOLD Level = x 1,5
DRIV& PLATINUM Level = x 2

The above multipliers apply to the supply of petrol, LPG, methane and diesel. The scores resulting from the multiplication will be rounded up to the nearest whole number.

By way of example, the following example is given: 15.7 litres of diesel purchased in Self-service will award 15 DRIV& PASSES and DRIV& POINTS. If the customer is at the DRIV& GOLD level, the 15 DRIV& PASSES and DRIV& POINTS will be multiplied by 1.5, thus obtaining 22.5 points. The total will then be rounded up to 23 PASS DRIV& and DRIV& POINTS.

The Promoter and the Co-Promoter reserve the right, after extensive communication to the Customers enrolled in the Program, to change the methods of access to the levels.

B. METHOD OF ACCUMULATING DRIV& PASSES and DRIV& POINTS

THROUGH THE PERFORMANCE OF VIRTUOUS ACTIONS

Various types of “virtuous actions” will be made available to the Customer through the DRIV& APP that Customers can carry out to obtain the DRIV& PASSES and DRIV& POINTS provided for each individual action.

It should be noted that the crediting of the amount due as PASS DRIV& and DRIV& POINTS may not be simultaneous with the completion of the action carried out and may require any checks on the performance by the Promoter and the Co-Promoter.

For all the virtuous actions provided for in the Regulations, it is obviously the responsibility of the Customer/participant to follow the performance instructions specified for each action.

Any performance other than those indicated will not result in any remuneration.

The virtuous actions available are the following:

  • o completion of CHALLENG&:
    The Customer has the opportunity to obtain benefits such as DRIV& POINTS and DRIV& PASSES (for the same amount), fuel discount vouchers or partner vouchers, upon completion of a CHALLENGE, as defined by the Promoter and the Co-Promoter for each individual CHALLENGE. The CHALLENGES are realised by carrying out one or more activities, which can be of various kinds and grouped into the following categories: actions related to refuelling/engagement actions in the App (e.g. complete the survey).  The Customer has the possibility to carry out the proposed CHALLENGES visible in the APP and/or transmitted through DRIV& channels and promoted by the Promoter and the Co-Promoter. The CHALLENGES may also be proposed for specific clusters of Customers;
  • or through the completion of QUIZ following timely communication, the Promoter and the Co-Promoter may propose to the Customer the performance of QUIZ. Customers who complete the QUIZ in accordance with the instructions communicated will obtain the DRIV& PASSES and DRIV& POINTS for the same amount provided for each QUIZ regardless of whether they have correctly answered the questions contained in the QUIZ. Each individual QUIZ can only e QUIZ will not result in any kind of remuneration and/or advantage;
  • or through the completion of SURVEY
    The Customer has the possibility to obtain DRIV& POINTS and DRIV& PASSES for the same amount, upon completion of the surveys visible in the DRIV& APP and/or transmitted through DRIV& channels, as defined by the Promoter and the Co-Promoter. The latter reserve the right to provide surveys for specific clusters of Customers. The Customer has the possibility to obtain DRIV& POINTS and DRIV& PASSES upon completion of the survey only once. Subsequent completion of the same survey will not allow the Customer to obtain any type of remuneration and/or advantage.


C. METHOD OF ACCUMULATING PASS DRIV& and DRIV& POINTS THROUGH THE “FRIEND CODE”

The “friend code” is available to each Customer and is unique for each of them. It can be found in the DRIV& APP and does not contain any personal information about the Customer. The Customer can share their personal “friend code” with other subjects (hereinafter also individually “Friend”), through personal systems and only with those who they believe are interested in the actual use.

To be valid, the “friend code” must be entered by the receiving Friend at the same time as the first registration in the APP and during registration.

The Customer who has provided the “friend code”, for each Friend who uses it correctly, will receive 50 DRIV& PASSES and 50 DRIV& POINTS up to a maximum of 150 DRIV& PASSES and 150 DRIV& POINTS per year, corresponding to 3 correctly registered Friends. The year will start from the date of the first valid entry of the code by a Friend.

Each Friend can use only one “friend code” during registration, and once entered it can no longer be replaced.

 

The “friend code” cannot be disseminated massively or in any way that can be considered “spam”. In the event of violation of the aforementioned provisions, the Promoter and the Co-Promoter have the right to exclude the holder of the “friend code”, i.e. the Customer, from the Program. Each Customer, holder of the “friend code” will be responsible for its dissemination and therefore must indemnify the Promoter and the Co-Promoter from any action, claim or request that may arise from any forwarding or sharing of the “friend code” that is unauthorised, or in any case in violation of the Regulations.

 

D. METHOD OF ACCUMULATING PASS DRIV& and DRIV& POINTS THROUGH BONUS POINTS

The Promoter and the Co-Promoter reserve the right to activate promotional initiatives that allow the accumulation of PASS DRIV& and DRIV& POINTS bonus. This will be communicated to Customers from time to time together with the methods of accumulation and the indication of the period of validity in which

these will be granted. Customers can access the same promotional initiative only once in the reference period, unless otherwise indicated in the participation methods.

The condition for obtaining these benefits is the maintenance of the same account relating to the DRIV&R Code with the purpose of allowing the identification of the Customer to attribute the benefits.

 

6. CHECKING DRIV& PASSES and DRIV& POINTS

The Promoter and the Co-Promoter reserve the right to carry out all the necessary checks for the correct attribution of the DRIV& PASS and DRIV& POINTS in relation to the conditions of participation in the Program provided for in the Regulations. In the event of situations that are improper in their unquestionable judgment, the Promoter and the Co-Promoter will contact the Customer for further clarification. In such cases, in the absence of adequate justification, the Promoter and the Co-Promoter reserve the right to suspend or block the DRIV&R Code on which improper transactions have been found, cancelling the PASS DRIV& and DRIV& POINTS Points even in the delivery phase of the Prizes, as well as to revoke the Customer’s membership in the Program.

In the event of revocation of membership in the Program and/or in the event of cancellation requests by the Customer, the DRIV& POINTS and DRIV& PASS balance of the DRIV&R Code will be cancelled.

In the event that the Customer has not carried out transactions for 6 (six) consecutive months (“Inactive Customer”), the Promoter and the Co-Promoter also reserve the right to reset the PASS DRIV& and DRIV& POINTS balance, in addition to cancelling all types of discounts that may be present and not yet used, as defined in paragraph 7 below. In the event of resetting the balance due to non-use of the DRIV&R Code, this will remain valid until the end of the Program.

7. PRIZES

The DRIV& POINTS accumulated by Customers can be used to request the conversion of the same for participation in promotional initiatives of the Partners or to request the Prizes listed in the updated Catalogue according to the DRIV& POINTS achieved – including the “Fuel Discount” – as published in the DRIV& APP and reported in Annex A of the Regulations; Catalogue in which the Prize category, the Prize code, the description, the number of DRIV& POINTS necessary and the DUC (Direct Unit Cost) for the Prizes obtained without contribution are indicated. Prizes can only be claimed using the accumulated DRIV& POINTS.

The Prizes indicated in the aforementioned Catalogue may be eliminated and/or replaced, as may the number of DRIV& POINTS required to request them,

exclusively on conditions of greater advantage for Customers, by the Promoter and the Co-Promoter.

The Promoter and the Co-Promoter also reserve the right to:

  • a) integrate, during the course of the Program, the number and type of Prizes available;
  • b) replace, during the course of the Program, the Prizes no longer available with others of equal or superior characteristics.

The Promoter and the Co-Promoter will deliver the Prizes within six months from the date of the correctly submitted request, in accordance with the provisions of the Regulations.

For each prize request made by the Customer, their balance will be updated with the deduction of the DRIV& POINTS relating to the requested Prize. It is not possible, for any reason, to cancel a reward request and regain the credit of the DRIV& POINTS used.

In the event that the chosen Reward is covered by a legal guarantee, this will be provided only by the manufacturer or distributor or by the facilities indicated by them; for any information, the Customer may call Customer Service on 0695582882.

7.1 HOW TO CLAIM PRIZES

From 06/11/2023 until 15/03/2027, Customers who have accrued a sufficient number of DRIV& POINTS to request one or more of the Rewards listed in the updated Catalogue published in the DRIV& APP may request them through the APP itself, using the function provided within the dedicated area. For the “Fuel Discount” reward only, it is also possible to request it by going to a Point of Sale participating in the Program. In this case, the Customer must present the manager with their DRIV&R Code visible in the DRIV& APP or their Italian Health Insurance Card and communicate the chosen Reward, i.e. the “Fuel Discount” in force at the time of the request. The Point of Sale manager shall enter all the information necessary for the management of the request and the Reward into the system.

The above procedures must be repeated for each reward request. The Promoter and the Co-Promoter reserve the right to carry out all the most appropriate checks: in the event that problems of any nature arise, they reserve the right to suspend the delivery of the requested Reward until the resolution of the same, as well as to cancel the DRIV& POINTS and DRIV& PASSES accumulated in the event that they find irregularities and/or anomalies, i.e. they may not deliver the Reward.

Before requesting the Reward, the Customer must take care to check, in the

appropriate section provided in the DRIV& APP or by calling Customer Service on 06 95582882, the correctness of the data concerning them and resulting in the system. The Promoter and the Co-Promoter will obviously not be liable for the non-delivery of the requested Reward in the event of incorrect or outdated data.

The mobile number and/or e-mail address provided during registration for the Program may be used for all communications relating to the Reward itself.

Requests for Prizes, once made, cannot be subsequently modified or cancelled.

Following the request for Rewards, the Customer receives a “reward code” that must be used to receive the Reward itself, even if it is provided by the Partners of the Promoter and the Co-Promoter. The Customer is solely responsible for the use of the “prize code”.

Failure to use it within the terms indicated in paragraph 13 will be considered as a definitive waiver of the Prize.

If the requested Prize is no longer available, the Promoter and the Co-Promoter will send a Prize of the same type and with the same or superior characteristics.

The Catalogue may not be accessible during periods of technical updating. In such situations the points balance of the participants and/or their status will not be changed, the prizes can be regularly requested at the time of reactivation.

 

7.2 CONVERSION OF THE PRIZE INTO FUEL IN RELATION TO THE DIRECT UNIT COST

As an alternative to the Prize and in relation to the provisions of Article 2, paragraphs 4 and 5 of Decree-Law No. 383 of 29 October 1999, converted into law, with amendments, by Law No. 496 of 28 December 1999, Customers may request a reduction in the price to be paid for the supply of fuel in an amount equal to the Direct Unit Cost (DUC) of the Prize itself for Prizes not subject to a cash contribution. The methods for requesting and managing the reduction of the price to be paid for the supply of fuel are those provided for the Prizes.

Not all Prizes paid in the form of Direct Unit Cost constitute prize money for this prize contest pursuant to Article 6, paragraph 1, letter c-bis of Presidential Decree 430/01, if applicable.

The amount will be credited directly in the section of the APP called “Fuel Discount Vouchers”. In the relevant section, Fuel Discounts will be credited, as well as any other discounts for specific promotions activated in certain periods within the Program.

The DUC of the individual Prizes provided in the Catalogue can be consulted on the APP and is expressed in euros.

8. WEBSITE AND TOLL-FREE NUMBER AND REFERENCES

For the duration of the Program and, subsequently, for the terms provided by law, the following references are available to Customers for information, Regulations, clarifications on the Program, operational assistance relating to transactions, points and delivery of the Prizes:

9. ADDITIONS/AMENDMENTS TO THE REGULATIONS

The Promoter and the Co-Promoter reserve the right to make changes to the Regulations during the course of the Program with more favourable conditions of participation or special actions that allow further PASS DRIV& and DRIV& POINTS to be accrued, notifying the Customers who are the recipients of the prize operation and with the publication of the updated version of the Regulations in the APP and on the Website.

10. PRIZE MONEY

The Promoter of the IPiù prize promotion had planned to award prizes for a total indicative value of €2,000,000.00 (two million/00), subject to adjustment at the end of the event, with a deposit of €400,000.00 (four hundred thousand/00) (equal to 20% of the value indicated above) as required by law.

With the extension of this operation, the Promoter and the Co-Promoter, during the course of the Program, have instead planned to award prizes for a total indicative value of €3,400,000.00 (three million four hundred thousand/00), subject to adjustment at the end of the event, with integration of the deposit up to €680,000.00 (six hundred and eighty thousand/00) (equal to 20% of the value indicated above) as per law.

11. ADVERTISING AND REGULATIONS

The advertising messages that will promote the event to the recipients of the same will be consistent with the Regulations.

The updated text of the Regulations is always available on the APP and on the Website and may also be requested by calling Customer Service on 06 95582882.

The Promoter and Co-Promoter reserve the right to use any means of communication that appears suitable to bring the content of the prize promotion to the attention of the recipients of the same.

12. PERSONAL DATA PROTECTION

Italiana Petroli S.p.A. and ESE S.r.l. (hereinafter also referred to as “the Joint Controllers”), with registered and administrative office in Rome, Via Salaria no. 1322 00138 Rome, as Joint Controllers, by virtue of a specific internal agreement stipulated between them pursuant to Article 26 of EU Regulation 2016/679 (hereinafter also referred to as “GDPR”), guarantee full compliance with the legislation on the protection of personal data in the performance of all procedures relating to the Program.

The essential content of the joint control agreement is made available at the following address Driveloyalty.it.

Customers’ personal data will be processed in compliance with the provisions of the Regulations and the privacy policy provided at the time of joining the Program. As part of the joint control agreement, Italiana Petroli S.p.A. has been designated as the contact point to which requests for the exercise of the rights guaranteed by Articles 15 et seq. of the GDPR can be addressed, through the following address: privacy@italianapetroli.it. The Joint Controllers have appointed a Data Protection Officer (“DPO”) who can be contacted at the following e-mail address: dpoitalianapetroli@pec.gruppoapi.com. Data subjects who believe that the processing of their personal data carried out pursuant to these Regulations is in violation of the provisions of the GDPR have the right to lodge a complaint with the Data Protection Authority, as provided for by Article 77 of the GDPR, or to take legal action. The Program operation management server is located in Italy.

In the event of withdrawal from the Program and/or cancellation requests by the Customer, a personal data retention period has been identified for exclusive administrative purposes (and not also for profiling or marketing), not exceeding one quarter from the request (without prejudice to any specific legal obligations on the retention of accounting documentation). After this period, personal data will be deleted.

13. REWARDS TABLE

The APP indicates the Rewards that can be requested from 06/11/2023 to 15/03/2027, unless otherwise specified for each Reward. For usage restrictions and other information on individual Rewards, you can check the Catalogue on the APP in the Rewards Catalogue section.

N.B.: Not all “fuel discounts” constitute prize money in this prize draw pursuant to Article 6, paragraph 1, letter c-bis of Presidential Decree 430/01, if applicable.
