class=\"ubi-text-highlight\">DRIV&amp;PAY<\/span>  General Terms and Conditions of Use - Safety Regulations<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-bf255b5 e-flex e-con-boxed e-con e-parent\" data-id=\"bf255b5\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-695df8b e-con-full e-flex e-con e-child\" data-id=\"695df8b\" data-element_type=\"container\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Below are the terms and conditions of use of the service called &#8220;DRIV&amp;PAY&#8221; (hereinafter also referred to as &#8220;DRIV&amp;PAY&#8221; or the &#8220;Service&#8221;) which is currently only available at authorised IP-branded fuel distribution facilities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-437a6ca elementor-widget elementor-widget-text-editor\" data-id=\"437a6ca\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>This service is offered with reference to the IPi\u00f9 Loyalty Program, which will be extended until 15\/03\/2027 and marketed under the name &#8220;DRIV&amp;&#8221; to extend it, also thanks to the synergy of ESE S.r.l. &#8211; a subsidiary of Italiana Petroli S.p.A. (hereinafter also &#8220;IP&#8221;) and licensee of the Esso brand &#8211; at Esso-branded service stations and beyond.<br \/>The updated list of stations enabled for this service, currently under the IP brand and later also Esso, will be published in the DRIV&amp; App (hereinafter also the &#8220;App&#8221;).<br \/>The Loyalty Program referred to above is promoted by Italiana Petroli S.p.A. &#8211; with registered office in Rome, Via Salaria no. 1322, 00138, share capital \u20ac47,665,314.00 fully paid up, tax code, VAT number and registration number in the Rome Companies Register 00051570893, REA registration RM 740950 \u2013 and as co-promoter ESE S.r.l. (hereinafter also &#8220;ESE&#8221;) \u2013 with registered office in Rome, Via Salaria no. 1322, 00138, \u2026\u2026\u2026\u2026\u2026\u2026\u2026<\/p><p>\u00a0<\/p><p>Acceptance of the following &#8220;Terms and Conditions of Use&#8221; is a necessary condition for access and use of the Service by the Customer registered in the IPi\u00f9 Program. Acceptance will take place by selecting the appropriate option &#8220;I have read and accept&#8221; and in this way it will be possible to access or use the Service on any smartphone or tablet (together &#8220;Devices&#8221;, individually &#8220;Device&#8221;).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-87b6abc elementor-widget elementor-widget-text-editor\" data-id=\"87b6abc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>1. Previsioni Generali<\/strong><\/p><ul><li><strong>1.1<\/strong> The Service allows to make payments for refuelling through the use of one or more payment cards configured by the Customer within the App and is aimed at all natural persons of legal age, qualifying as &#8220;consumers&#8221;, resident\/domiciled in the area covered by the prize operation called &#8220;IPi\u00f9&#8221; and marketed as &#8220;DRIV&amp;&#8221; by Italiana Petroli and ESE S.r.l. (hereinafter also referred to as the &#8220;<strong>Program<\/strong>&#8220;), holders of the DRIV&amp;R CODE (hereinafter also referred to as the &#8220;<strong>Customers<\/strong>&#8221; or, in the singular, &#8220;<strong>Customer<\/strong>&#8220;). The Program will not apply to heavy vehicles (over 3.5 tonnes). The managers of the participating Points of Sale (hereinafter also referred to as &#8220;<strong>Points of Sale<\/strong>&#8221; or, in the singular, &#8220;<strong>Point of Sale<\/strong>&#8220;), i.e. the owners or legal representatives of the management, any of their partners, employees, collaborators and their close relatives, are excluded from participating in the Program and using the Service.<\/li><li><strong>1.2<\/strong> The availability of the Service may vary depending on the configuration of the Point of Sale and therefore the list of Points of Sale where the Service can be used is always available in the appropriate section of the App (hereinafter also &#8220;Enabled Points of Sale&#8221;). At present, the Service can be used to pay a maximum amount of \u20ac100.00 (one hundred\/00 euros) for each refuelling.<\/li><li><strong>1.3<\/strong> The use of the App is free but obviously the costs of accessing the Internet for the operation of the App and the Service are charged to the Customer based on the contract in place with their telephone operator. The App contains services and features that are only available for certain mobile devices.<\/li><li><strong>1.4<\/strong> The data of the payment cards configured within the App and the operations carried out on them are managed by the mobile gateway service provided by N&amp;Ts and by the acquiring service of Nexi Payments S.p.A. (hereinafter also referred to as &#8220;Acquirer&#8221;), according to the PCI\/DSS (Payment Card Industry Data Security Standard) security and protection standards. For more information on the PCI\/DSS standard, please visit www.pcicouncil.org.<\/li><li><strong>1.5<\/strong> The use of the App and the Service must take place in compliance with the applicable regulations on the subject and in compliance with the &#8220;Terms and Conditions of Use&#8221; referred to in this document. In particular, the Customer must use the App exclusively at the enabled Points of Sale while inside their car. The App must never be used while driving. It is also good practice not to use the Device while refuelling.<\/li><li><strong>1.6<\/strong> The Customer must use the App in such a way as not to compromise, overload or damage it and in such a way as not to jeopardise or circumvent the purposes of the App and\/or the Service. The Client must not, either personally or through third parties, circumvent or modify the security measures of the App and\/or the Service. All rights to the software remain with IP and ESE. The software provided to the Customer must not be copied, modified, redesigned, decoded or distributed.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c9a7d3 elementor-widget elementor-widget-text-editor\" data-id=\"5c9a7d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>2. Iscrizione<\/strong>\n<ul>\n \t<li><strong>2.1<\/strong> PTo use the Service, the Client, after accessing the Program through the appropriate functionality on the App, must access the &#8220;Enable DRIV&#038;PAY&#8221; section of the App and enter their personal data, tax code, a valid e-mail address and mobile phone number. In order to request the electronic invoice, the Customer must enter the data deemed necessary: Company name, VAT number, SDI code, certified e-mail address (if applicable), complete address with house number and postcode, number plate or number plates of the cars to be chosen or set as favourite(s). The electronic invoice will be requested through the APP following a payment made with the App only in the enabled Points of Sale, visible in the appropriate section of the App itself. The Customer will also be asked to enter their access password to confirm the operation; the FaceID and ThouchID biometric recognition functionality is provided on some Devices by activating the appropriate function on them. IP and\/or ESE accept no liability for technical problems related to the Customer&#8217;s telephone operator that may hinder registration to the App and\/or the Service.<\/li>\n \t<li><strong>2.2<\/strong> The information referred to in Articles 12 and 13 of EU Regulation 2016\/679 (&#8220;GDPR&#8221;), relating to the processing of personal data carried out as part of the use of the Service, is made available within the App and is brought to the attention of the Customer, by confirmation of acknowledgement, before joining the Service.<\/li>\n \t<li><strong>2.3<\/strong> The Customer undertakes to provide their personal data, verifying that they are truthful, accurate and up-to-date, within the limits of what is necessary to allow the provision of the Service, as requested during the registration process in accordance with the privacy policy issued to the Customer.<\/li>\n \t<li><strong>2.4<\/strong> The access credentials to the App and the Service must be diligently kept by the Customer to prevent them from being known by third parties. The Customer is solely responsible for the confidentiality and security of their account and will be liable for any illegal or unauthorised use. Any unauthorised use must be immediately communicated to italiana petroli S.p.A. or ESE. IP and\/or ESE will not be liable for any damage caused by the unauthorised use of a Customer&#8217;s account and\/or secret codes, even if such access occurred independently of their will. In the event of a lost password, the Customer can request a new one from italiana petroli S.p.A. and\/or ESE via the App, which will be sent to him\/her via SMS.<\/li>\n \t<li><strong>2.5<\/strong> During the Service activation process, the Customer must configure one or more payment cards (credit card, prepaid card or international debit card) or enable the Apple Pay service for enabled devices. The configuration of a payment card is a necessary condition for the use of the Service and allows the use of the &#8220;DRIV&#038;PAY&#8221; payment function for refuelling.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-554deda elementor-widget elementor-widget-text-editor\" data-id=\"554deda\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>3. Payment cards<\/strong>\n<ul>\n \t<li><strong>3.1 <\/strong>During registration or at any time thereafter, the Customer may decide to configure one or more payment cards (credit cards, prepaid cards or international debit cards) belonging to the American Express, Mastercard, Visa circuits, after verifying the suitability for online payments of the aforementioned cards by entering name, surname, expiry date, CVV2 or verification code.<\/li>\n \t<li><strong>3.2 <\/strong>The Customer can remove a payment card associated with their profile at any time by accessing the appropriate section of the &#8220;Payment Data&#8221; App within the &#8220;DRIV&#038;PAY&#8221; area. If the Customer wishes to add a removed payment card again, he\/she must repeat the association procedure in the App through the appropriate &#8220;Payment cards&#8221; section. Each payment card can be associated with only one App holder.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7549f03 elementor-widget elementor-widget-text-editor\" data-id=\"7549f03\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>4. Program<\/strong>\n<ul>\n \t<li><strong>4.1<\/strong> The use of the Service automatically guarantees the Customer the attribution of the benefits deriving from the adhesion to the Program in the ways and according to the terms provided by the Regulations of the same always available within the App.<\/li>\n \t<li><strong>4.2 <\/strong>When using the Service, if they wish and only at participating Points of Sale, the Customer may deduct the fuel discounts accumulated by participating in the Program from the amount to be paid for the individual refuelling, using the &#8220;Use the amount of the fuel discount vouchers&#8221; function in the &#8220;DRIV&#038;PAY&#8221; section of the App on the screen following the selection of the fuel pump number. Any remaining amount to be paid for the refuelling will be charged to the payment card.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a41951 elementor-widget elementor-widget-text-editor\" data-id=\"1a41951\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>5. 5. Availability and payment for refuelling<\/strong><\/p><ul><li><strong>5.1<\/strong> The Customer has no right to the constant and uninterrupted availability of the Service and\/or the App. The Customer can always freely choose whether or not to use the Service for the payment of fuel and is always free to change his choice until payment is made.<\/li><li><strong>5.2 <\/strong>To pay for a refuelling with the App at a Point of Sale, the Customer must first position their vehicle near the fuel pump enabled for payment with the App (hereinafter also only &#8220;Enabled Fuel Pump&#8221;). The Enabled Fuel Pump, which at present can only be &#8220;SELF&#8221; with pre-pay payment method, is identified with the fuel pump number indicated on each of these. italiana petroli S.p.A. and ESE S.r.l. reserve the right to activate the use of the Service at their discretion also in post-pay and full service mode.<\/li><li><strong>5.3<\/strong> The Client who has chosen to pay with the App will then have to occupy the area of the Fuel Pump with active payment (in cash or payment cards) to the automatic acceptor.<br \/>In this case:<br \/><b>a<\/b>. the Customer must start the App inside their car, access the Service and select the fuel pump to be enabled for refuelling. To this end, the Customer must access the &#8220;DRIV&amp;PAY &#8221; section of the App and select the fuel pump from the list provided by the App itself (list visible only if the Customer&#8217;s position is recognised by the geolocation system as present on an enabled Point of Sale);<br \/><b>b<\/b>. the Customer must choose the amount of the refuelling from those proposed by the App. To refuel, it will be necessary to enter the password or use the recognition through biometric data chosen during the activation of the Service;<br \/><b>c<\/b>. the Customer, before making the request for authorisation of the chosen amount, must enter the secret code. Once the code has been entered, a pre-authorisation of the chosen amount will be carried out using one of the payment cards available within the App. If provided by their Banking Institution, the Customer may receive a text message confirming the authorisation of the total amount selected. The Client may request the pre-authorisation of a minimum amount of fuel equal to \u20ac1 (one\/00 euro) up to a maximum amount of \u20ac100.00 (one hundred\/00 euro). It is possible to dispense a maximum amount of fuel for a value equal to the amount chosen for refuelling and therefore pre-authorised using the payment cards within the App; the pre-authorisation of the amount is managed by the Acquirer;<br \/><b>d<\/b>. the fuel pump will be enabled for refuelling only if the pre-authorisation of the amount chosen by the Customer is successful. In this case, the App will inform the Customer that they can refuel; therefore, the Customer, leaving the mobile phone in the car, can start refuelling by extracting the nozzle from the fuel pump. In the event that the Customer does not extract the nozzle from the fuel pump to start refuelling or in the event that the nozzle is extracted from the fuel pump but no fuel is dispensed, the Customer must wait at the Point of Sale until they receive a message on the App about the outcome of the transaction. In the event that no fuel is dispensed, the pre-authorisation carried out on the Customer&#8217;s payment card will be automatically cancelled by the system and the amount will be made available again to the Customer according to the times provided by the bank or financial institution issuing the card;<br \/><b>e<\/b>. in the event of failure of the pre-authorisation of the amount chosen by the Customer, in order to be able to refuel with the App, the Customer must repeat the procedure, taking care to check that they have availability on the new payment card selected or must configure a different payment card within the App and proceed again with the selection of the fuel pump or, failing that, must make the payment through the appropriate automatic acceptors present on the forecourt of the Point of Sale;<br \/><b>f<\/b>. at the end of refuelling, the Customer must hang up the nozzle to the fuel pump. Only after hanging up the nozzle will the Customer be able to view the amount spent and the litres dispensed on the App. The history of the transactions carried out will be visible on the App in the &#8220;Transactions&#8221; section and will be transmissible in the manner provided by the Device. The amount charged to the Customer&#8217;s payment card will be equal to the amount of fuel actually dispensed (amount displayed on the fuel pump at the end of refuelling) net of any use, if requested by the Customer, of the fuel discount vouchers provided by the Program loaded within the App;<br \/><b>g<\/b>. at any time, from the &#8220;Transactions&#8221; section of the App, the Customer can check the transaction history and, if desired, receive by e-mail the summary of the individual refuelling operations carried out;<br \/><b>h<\/b>. if the Customer, prior to refuelling, has entered the data necessary to request the electronic invoice, they may proceed simultaneously with the refuelling request to the invoicing request on the enabled Points of Sale, which will be successful only in the event of a successful refuelling and the related payment.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d2a408e elementor-widget elementor-widget-text-editor\" data-id=\"d2a408e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>6. 6. Use of the App and the Service <\/strong><\/p><ul><li><strong>6.1<\/strong> The Customer may:<br \/><strong>a.<\/strong>\u00a0access the Service in compliance with the &#8220;Terms and conditions of use&#8221; of this document..<\/li><li><strong>6.2 <\/strong>The Customer may not:<br \/><strong>a.<\/strong> a. copy, distribute, transmit or modify in any way the material contained in the App either partially or entirely;<br \/><b> b<\/b>. remove copyrights, trademarks or other intellectual property rights contained in the App;<br \/><b> c<\/b>. create links to the App from other Applications or websites;<br \/><b> d<\/b>. use the Service (or part thereof) in violation of applicable laws or regulations or in breach of the &#8220;Terms and Conditions of Use&#8221; referred to in this document (e.g. hacking, entering malicious codes including viruses or harmful data);<br \/><b> e<\/b>. use the App and\/or the Service in such a way as to damage, disable, overload, endanger or compromise the security of IP or ESE systems or interfere with and\/or intercept those of any other Customers present at the Point of Sale;<br \/><b> f<\/b>. intercept or collect information or data transferred from the App or to the IP and\/or ESE systems or attempt to decrypt any data transmission between the App and its servers;<br \/><b> g<\/b>. circumvent or modify any security technology of the App, without the express written consent of IP and\/or ESE;<br \/><b> h<\/b>. use the App or any of its features for commercial purposes or otherwise different from those referred to in this document.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-abe9147 elementor-widget elementor-widget-text-editor\" data-id=\"abe9147\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>7. 7.\tIntellectual property rights<\/strong>\n<ul>\n \t<li><strong>7.1 <\/strong>The intellectual property rights relating to the App and the Service are owned by Italiana Petroli S.p.A. and\/or ESE or their licensors. All the contents of the App and, by way of example but not limited to, text, software, scripts, code, drawings, graphics, photos, sounds, music, videos, interactive features and all other content (hereinafter also referred to as &#8220;Content&#8221;) are the exclusive property of IP and\/or ESE and are governed by the applicable copyright laws.<\/li>\n \t<li><strong>7.2<\/strong> The trademarks relating to the App are owned by Italiana Petroli SpA and\/or ESE or their licensors.<\/li>\n \t<li><strong>7.3<\/strong> Nothing written in the &#8220;Terms and Conditions of Use&#8221; of this document shall be construed as granting any license to intellectual property rights on content owned by IP or ESE or their licensors, nor shall it give rise to any other form of assignment or transfer of intellectual property.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f8b1380 elementor-widget elementor-widget-text-editor\" data-id=\"f8b1380\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>8. Privacy<\/strong>\n<ul>\n \t<li><strong>8.1<\/strong>Personal data relating to the Customer are processed by italiana petroli S.p.A., also jointly with ESE S.r.l., through the App and\/or the Service in compliance with the current legislation on the protection of personal data (including the EU Regulation 2016\/679 and the Legislative Decree 196\/2003 &#8211; &#8220;Privacy Code&#8221;). Before activating the Service, the Customer is invited to read the attached privacy policy, which is an integral part of this document and illustrates in detail the methods and purposes of the processing carried out in the context of the provision of the Service.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0225ee5 elementor-widget elementor-widget-text-editor\" data-id=\"0225ee5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>9. Liability clause<\/strong>\n<ul>\n \t<li><strong>9.1 <\/strong>The correct entry of data and information within the App (such as name, surname, tax code, mobile phone number, e-mail address, payment card data, holder and data of the payment card(s)) is the sole responsibility of the Customer. IP and\/or ESE will not be liable in any way for damages that may result from the incorrect entry, transmission and\/or use of the Customer&#8217;s data and\/or information. IP and\/or ESE will not be liable, under any circumstances, for the total and\/or partial loss of data as well as their dissemination or illegal or unauthorised use, as the Client is solely responsible for the back up of their data and the custody of credentials and\/or access codes. <\/li>\n \t<li><strong>9.2<\/strong> IP and\/or ESE shall not be liable in any way for the conduct of the managers of the Points of Sale or their employees\/associates in violation of the &#8220;Terms and Conditions of Use&#8221; of this document. <\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-791bf01 elementor-widget elementor-widget-text-editor\" data-id=\"791bf01\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>10. Changes to the App or the &#8220;Terms and Conditions of Use&#8221;&#8221;<\/strong>\n<ul>\n \t<li><strong>10.1 <\/strong>The parties mutually acknowledge that the mobile payment sector is constantly and rapidly evolving. IP and\/or ESE reserve the right at any time to suspend the operation of the App or some of its features or to update and\/or supplement or modify them, for justified reasons (by way of example: legislative\/regulatory changes, technical and\/or IT security requirements, etc.), as well as to update or modify the &#8220;Terms and Conditions of Use&#8221; of this document.<\/li>\n \t<li><strong>10.2<\/strong>In the event of modification or integration of the &#8220;Terms and Conditions of Use&#8221; by IP and\/or ESE, the Customer will be informed of this on first access. In order to proceed and use the Service, the Customer must therefore accept the new terms and conditions. In the event that the Customer does not intend to accept the new &#8220;Terms and Conditions of Use&#8221;, it will not be possible to proceed with the use of the Service and, in this case, the Customer may withdraw without charge by giving notice in the manner indicated in the following Article 13.<\/li>\n \t<li><strong>10.3<\/strong> App updates will be released from time to time through the Apple Store or Google Play. The Customer may not be able to use all or part of the App before downloading the latest version. Italiana petroli S.p.A. and\/or ESE S.r.l. will not be liable for the failure of the Service for technical reasons not attributable to them.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9650b43 elementor-widget elementor-widget-text-editor\" data-id=\"9650b43\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>11. Assignment<\/strong>\n<ul>\n \t<li><strong>11.1 <\/strong>Italiana petroli S.p.A. and\/or ESE may at any time assign their rights and obligations under this document to any other party, upon written notice to the Customer and without any compensation or indemnity of any kind in favour of the latter.  <\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cab5166 elementor-widget elementor-widget-text-editor\" data-id=\"cab5166\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>12. Severability<\/strong>\n<ul>\n \t<li><strong>12.1<\/strong>Each of the clauses or sub-clauses of this document operates separately. The invalidity, illegality or ineffectiveness of any clause or sub-clause of this document will not affect the validity and effectiveness of the other clauses or sub-clauses<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a78581 elementor-widget elementor-widget-text-editor\" data-id=\"8a78581\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>13. Withdrawal, deactivation and\/or suspension of the account and termination<\/strong><\/p><ul><li><strong>13.1<\/strong>The Customer may withdraw from this contract at any time by notifying Italiana petroli S.p.A. or ESE S.r.l. using the form dedicated to &#8220;DRIV&amp;PAY &#8221; on the website\u00a0<a href=\"http:\/\/www.gruppoapi.com\" target=\"_blank\" rel=\"noopener\">www.gruppoapi.com<\/a>\u00a0. The withdrawal will be effective with immediate effect.<\/li><li><strong>13.2<\/strong> IP e\/o ESE potranno, in qualsiasi momento, con un preavviso di almeno 30 giorni, recedere dal contratto, dandone comunicazione al Cliente all\u2019indirizzo e-mail fornito in fase di iscrizione all\u2019App.<\/li><li><strong>13.3<\/strong> IP e\/o ESE si riservano il diritto di sospendere e\/o rimuovere l&#8217;account di un Cliente e\/o impedirne l&#8217;accesso all\u2019App e\/o al Servizio in caso di uso anomalo degli stessi, come ad esempio in caso di utilizzo di credenziali o documenti falsi o comunque non riconducibili al Cliente e\/o in violazione dei presenti \u201cTermini e condizioni di utilizzo\u201d, senza che da ci\u00f2 possa derivare per il Cliente diritto al riconoscimento di somme o indennit\u00e0 di alcun genere.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c3b2b7e elementor-widget elementor-widget-text-editor\" data-id=\"c3b2b7e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>14. Express termination clause<\/strong><\/p><ul><li><strong>14.1<\/strong> 14.1 This contract will be terminated automatically, pursuant to and for the purposes of Article 1456 of the Italian Civil Code. paragraph II, upon the occurrence of one of the following hypotheses:<br \/><strong>a.<\/strong> Violation by the Customer of even one of the prohibitions set out in Article 6.2;<br \/><strong>b.<\/strong> b. Failure to comply with even one of the obligations under Articles 1.6, 2.4 and 18;<br \/><strong>c.<\/strong> c. Failure to comply with the obligation of correctness of the data referred to in Article 2.3.<\/li><li><strong>14.2<\/strong> Termination by operation of law shall occur when Italiana Petroli S.p.A. and\/or ESE S.r.l. declare to the Customer that they intend to invoke the express termination clause, without prejudice to their right to compensation for any damages suffered.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f433434 elementor-widget elementor-widget-text-editor\" data-id=\"f433434\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>15. Communications<\/strong><\/p><ul><li><strong>15.1 <\/strong>For questions or complaints relating to the functionality and\/or use of the App and\/or the Service, the dedicated form on the website\u00a0<a href=\"http:\/\/www.gruppoapi.com\" target=\"_blank\" rel=\"noopener\">www.gruppoapi.com<\/a>\u00a0is available to Customers.<\/li><li><strong>15.2<\/strong> Communications or complaints about alleged fraudulent, illegal use, or due to loss of credentials and\/or identification codes relating to payment cards combined with the Customer profile, must be addressed to the competent credit institution.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-700a19f elementor-widget elementor-widget-text-editor\" data-id=\"700a19f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>16. Jurisdiction<\/strong>\n<ul>\n \t<li><strong>16.1 <\/strong>These &#8220;Terms and Conditions of Use&#8221; are governed by and shall be construed in accordance with Italian law. In the event of any dispute, the court of the place of residence or domicile of the Customer shall have jurisdiction.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-121d85c elementor-widget elementor-widget-text-editor\" data-id=\"121d85c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>17. Specific clauses<\/strong>\n<ul>\n \t<li><strong>17.1<\/strong> By selecting the appropriate acceptance option on the App, the following clauses must be specifically approved by the Client, pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code: Article 1.6 &#8220;General Provisions&#8221;; Articles 2.3 and 2.4 &#8220;Registration&#8221;; Article 5.1 &#8220;Availability and payment for refuelling&#8221;; Article 6.2 &#8220;Use of the App and the Service&#8221;; Article 9. &#8220;Liability clause; Article 10 &#8220;Changes to the App or to the Terms and Conditions of Use&#8221;; Article 11 &#8220;Assignment&#8221;; Article 13 &#8220;Withdrawal, deactivation and\/or suspension of the account and termination; Article 14 &#8220;Express termination clause&#8221;; Article 16 &#8220;Jurisdiction&#8221;; Article 18 &#8220;Rules of conduct to protect safety&#8221;.<\/li>\n \t<li><strong>17.2<\/strong> The Contract shall commence upon receipt of acceptance, in electronic form, of these \u2018Terms and Conditions of Use\u2019.<\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b6faf85 elementor-widget elementor-widget-text-editor\" data-id=\"b6faf85\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<strong>18. Rules of conduct to protect safety <\/strong>\n\nThe following are the rules of conduct that the Customer must comply with when using the App.\n\n<strong>a.<\/strong> <strong>Self-service refuelling through advance payment with APP.\nMOTOR VEHICLES (with closed passenger compartment)\nUpon arrival at the Point of Sale:<\/strong>\n<ol>\n \t<li>Position the vehicle near the dispensing column.<\/li>\n \t<li>Switch off the engine.\n<strong>\nUsing the APP<\/strong>:<\/li>\n \t<li>Stay inside the car, with the windows and doors closed<\/li>\n \t<li>Access the APP, select the &#8220;DRIV&amp;PAY&#8221; function and proceed with the refuelling request operation, indicating the dispensing column where the car is positioned.<\/li>\n \t<li>Wait for authorisation<\/li>\n \t<li>Keep your smartphone inside the locked vehicle and proceed with refuelling.\nBefore restarting:<\/li>\n \t<li>After refuelling, place the dispensing nozzle in the appropriate housing.<\/li>\n<\/ol>\n<strong>\nb.<\/strong> <strong>MOTORCYCLES, MOTOR VEHICLES, MOPEDS AND VEHICLES WITH OPEN PASSENGER COMPARTMENT.\n<\/strong>Without prejudice to the above provisions, the use of the App is allowed only within the premises of the Point of Sale or in a safe area indicated by the manager where present.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>DRIV&amp;PAY General Terms and Conditions of Use &#8211; Safety Regulations Below are the terms and conditions of use of the service called &#8220;DRIV&amp;PAY&#8221; (hereinafter also referred to as &#8220;DRIV&amp;PAY&#8221; or the &#8220;Service&#8221;) which is currently only available at authorised IP-branded fuel distribution facilities.
